VACATION RENTAL AGREEMENT
SHORT TERM & LONG TERM
The Vacation Rental Agreement is made by and between Steve and Jennifer Jacob (Owners) and the Guest/s, specified on the booking reservations. Once the reservations are confirmed by the Owners, the agreement then takes full effect. Throughout the agreement, the Owners and Guests may be described in the singular and plural terms as “Party” and “Parties,” respectively. Below are the specific aspects of the Agreement of both parties.
1] THE PROPERTY/ACCOMMODATION
- a) The accommodations are fully furnished and are described in two parts:
- i) a private bedroom with attached toilet and bath;
- ii) a house with two bedrooms, 2 bathrooms, kitchen and living room with enclosed
dining area.
Both accommodations are located at 128 Belmont Circular Road, Belmont-Port of Spain, Trinidad. They contain the following amenities.
- air condition • Twin/Full/Queen/King Size beds
- closet/s • hot water
- WiFi TV • toiletries, linens & towels
• table and chair/s • microwave - refrigerator • electric kettle
- iron, ironing board • parking for vehicles
- wares, pots, pans, utensils* • electric stove*
2] RENTAL PARTY & MAXIMUM OCCUPANCY
- ALL persons in the rental party would be bound by the terms of this agreement.
- Only persons listed on the reservation may stay on the property. The maximum number of paid persons allowed to stay in each room are 2.
- Friends, family members or visitors of the rental party would also be bound by the terms of this agreement.
- Guests will be charged without notice for additional persons staying overnight in the Accommodations and not disclosed to Owners.
3] VISITORS
- a) A visitor is an occupant of the Property who is not staying overnight nor spending
over 4 hours on any given day at the property.
- b) The total number of visitors permitted in the Accommodation or on the Property at
any given time, are two (2).
- c) No visitor will be allowed to stay on the property or use the common facilities, when
the Guest (of that visitor) is not on the Property.
- d) Visitors are not to use the facilities for their personal use. The amenities are for the
sole benefit of paying guests.
4] PARKING
- Parking is limited to Guests only in the designated parking areas.
- Parking spaces are not available for friends, family members or visitors of the Guest/s. Any illegally parked cars may be subject to towing and/or fines.
- Parking of a rental or personal car on the premises is done so at one’s own
risk. The Hostess/Owner would bear no responsibility for any damages or losses
incurred, while parked on the property.
5] HOUSE KEEPING/CLEANING
- Daily housekeeping services are not included in the rental rate. Throughout the rental period, Guests will be responsible for keeping the Room/Accommodation clean and in good condition.
- Any unsafe or dangerous condition must be reported to the Owners immediately.
- On the Arrival Date, the Guest/s must acknowledge that the Property is in good condition. If any defects are found, the Guest/s must report them to the Owners within 24 hours of the Arrival Date.
- All contents of the Property belong to the Owners. If an item should break or become damaged to some extent, the Guest must notify the Owners immediately.
- Upon Departure, the Property should be left in the same condition as it was found by the Guest/s on the Arrival Date.
- Any excessive untidiness, trashing or substantial damages to the property, would result in reasonable compensation for cleaning or repairs, on part of the Guest/s.
6] CHILDREN’S ACCOMMODATIONS
- a) Children (ages 5+) could only be accommodated during the periods outside of
the Carnival season.
- b) Children must be supervised at ALL times when they are on the premises. No
children should be left outdoors or indoors by themselves.
- c) Children must not enter the rooms of other guests nor should they be in the
kitchen area.
- d) Children are not to use any items found in the accommodations as toys (such
as remote controls, utensils or any other objects on the premises). Likewise,
adults are the only ones to turn on/off the TVs or ACs, using the remotes
provided.
- e) Playing that involves running and throwing objects should not take place
indoors. If possible, the Hostess/Owner will designate a safe space for playing (away from parked cars or other things that could be harmful or be damaged).
- f) Babysitters of guests will not be permitted to stay on the premises. Any
arranged babysitting must take place at another location.
7] KEYS/REMOTES/ACCESS CODES
- The Owners will provide Guest/s of each room with two (2) keys and/or access codes for entry doors. If the guest bears a license and has a car, then they will also receive a remote for the front gate.
- Keys/Remotes/Access Codes given to the Guest/s may not be duplicated or shared with any other persons. If keys or remotes are lost, the owner must be notified immediately. In addition, a fee of $28TT per key and/or $330TT per remote would be charged in order to replace any lost or unreturned key or remote.
- Any attempt to access a locked area is just cause for immediate termination of this Agreement and forfeiture of all rent paid. In such cases, the Guest/s will be liable for any missing items or damage to the property.
8] RENTAL PERIOD- CHECK-IN & CHECK OUT
- The term of this agreement will be from the designated “Arrival Dates” to the designated “Departure Dates,” so stipulated on the reservation. The Accommodation/Room will be ready for Guest’s occupancy beginning at 3pm on the reserved Arrival Date and the Property must be vacated by 12pm on the reserved Departure Date, unless otherwise agreed upon by the Owners.
- If the accommodation is available and fully cleaned prior to 3pm on any given reserved Arrival Date, then the Guest may be permitted to enter the premises.
- If the Guest/s or any member of the Rental Party remains on the Property beyond the expected Departure Date and time, the Guest/s will be responsible to pay the additional rental rate prescribed below (#13) for the overstay period.
9] RENTAL RULES & RESTRICTIONS
Guests agree to abide by the following restrictions stipulated by the Owners:
(i) SMOKING, VAPING, SMOKERS OR VAPERS are not permitted on the premises.
(ii) Pets are not permitted on the premises.
(iii) Parties, small gatherings and loud music are not allowed on the premises.
(iv) Illegal drugs, substances or deadly weapons are not allowed on the premises.
(v) Loud talking, arguments and acts of violence are not permitted on the premises.
(vi) Communicable disease carriers whose presence may cause harm to others are not
allowed on the premises
(vii) Loss of items within the Property or damage to the Property or furnishings, in
excess of normal wear and tear, will be charged to the Guest. Prior to departure, the Accommodation/Room will be inspected. If any damages are detected, then part or all of the security deposit would be withheld by the Owners, as compensation for repairs or replacements.
(viii) Guests (or anyone associated with the guests) are not permitted to alter the wiring of
any electrical device or appliance (television, AC, hot water heater, light fixture, ceiling fan, iron, etc.) found in their rooms.
(ix) Dismantling of smoking detectors or carbon monoxide detectors is not allowed.
(x) Guest/s or their visitors are not permitted to pick any fruits or take any part of the
trees or plants situated on the premises.
(xi) Outdoors and areas that are not designated as toilets, are not to be used as
bathroom facilities.
(xii) ALL GARBAGE are to be removed from the accommodations and be disposed of in the
large bin provided at the bottom of the steps.
(xiii) Usage of the owner’s private areas of the residence is not permitted.
If any person in the Rental Party fails to follow any of the Rules, the designated Rental Party/Guest may be asked to vacate the Property and their payment will be forfeited.
10] WASHING OF CLOTHING, HAIR, SHOES, NON HOUSEHOLD ITEMS &
REMOVAL OF DIRT, SAND, MUD, PAINT, OIL & OTHER SUBSTANCES OF THE
KIND.
- i) ALL WASHING OF CLOTHING is to be done in the washroom area. Guests are to
provide their own detergent, fabric softener, etc. Lines are set up on the western
side of the house for drying clothes.
- ii) WASHING OF HAIR, SHOES OR NON HOUSEHOLD ITEMS are to be done in the
sink by the washroom area. Shoes are not to be placed in either the washing
machine or dryer.
iii) REMOVAL OF DIRT, SAND, MUD, OIL, PAINT or other substances of the kind
must be done outdoors, using the hose provided. The bathroom showers or sinks
throughout the accommodation are not to be used to remove the above
substances from either one’s clothing, personal items, body or otherwise. In
addition, linens, bath, beach or kitchen towels provided are not to be used to
wipe off/clean the above substances from one’s person or personal items. Any
household effects or areas that are soiled by such substances would be deducted
from the security deposit for the respective repair or replacement thereof.
- iv) Clothing (swimwear, etc.), beach towels, rugs or mats are to be washed out
in the sink area by the washroom before being placed in the washing machine or
dryer.
11] CANCELLATION
- A Guest may cancel their reservations at any time, however, their payment would not be refunded.
12] PAYMENT CHART (subject to change)
Guests hereby agree to pay the nightly rent described below in USD currency. Payment in full will be due upon reservation confirmation. Reservations are on a “First Pay, First Serve,” basis.

- b) Acceptable payment methods are: wire transfer bank deposits cash
NB: GUESTS MUST COVER ALL TRANSACTIONAL FEES. THEREFORE SUCH FEES CANNOT BE DEDUCTED FROM THE RENTAL COST.
- c) SECURITY DEPOSIT
A security deposit of $250US per adult must be paid at least two weeks prior to check in. Then upon check out, the deposit will be refunded, if there are no major damages to the property. The Owners’ inspection and evaluation would determine the outcome.
13] DISCARDING OF PERSONAL ITEMS
Personal items are not to be left outside the accommodation. If shoes, clothing or
other items of the kind need to be aired or dried, please use the designated areas
located on the western side of the stairway (clothing lines and concrete surfaces
for sunning).
14] MECHANICAL FAILURES
- Throughout the course, the Owners will attempt to properly maintain the Property. While all electrical and mechanical equipment within the Property are in good working order, Owners cannot guarantee against mechanical failure of electrical service, stopped plumbing, water supply, heating, air conditioning, audio visual equipment, internet access, cable service or appliances.
- Guests should report any inoperative equipment or other maintenance problem to the Owners immediately.
- The Owners will make every reasonable effort to have repairs done quickly and efficiently. In addition, the Guest/s will allow the Owners or a person permitted by the Owners access to the Room/Accommodation for purposes of repair and inspection.
- The Owners are not responsible for any inconvenience that may occur and no refunds or reductions will be made due to failure of such items.
15] LIMITATION ON LIABILITY
- The Owners are not responsible for any accidents, injuries or illness that may occur to any member of the Rental Party or their guests while in or on the Property.
- The Owners are not responsible for loss of personal belongings or valuables belonging to any member of the Rental Party or any of their visitors.
- The Guest agrees to assume the risk of any harm arising from use of the Property. UNDER NO CIRCUMSTANCES AND UNDER NO LEGAL THEORY, INCLUDING TORT, CONTRACT, STRICT LIABILITY, OR OTHERWISE, SHALL THE OWNERS BE LIABLE TO GUEST/S OR ANY OTHER PERSON FOR ANY DAMAGES OF ANY NATURE WHATSOEVER, INCLUDING ARISING OUT OF OR RELATING TO THIS AGREEMENT, OR GUEST’S RENTAL OF THE PROPERTY OR USE OF THE PROPERTY. IN NO EVENT WILL THE OWNERS BE LIABLE FOR ANY DAMAGES IN CONNECTION WITH THIS AGREEMENT, EVEN IF THE OWNERS WOULD HAVE BEEN INFORMED OF THE POSSIBILITY OF SUCH DAMAGE.
16] INDEMNIFICATION
- The Guest/s acknowledges that the use of the Property by the Rental Party and their visitors are entirely at their own risk.
- The Guest/s will indemnify and hold harmless the Owners from any and all expenses, costs, damages, suits, actions, or liabilities whatsoever arising from or related to any and all loss of or damage to personal property, including injury or death resulting from the use or occupancy of the Property or the failure of any member of the Rental Party or their visitors to observe the rules and restrictions set forth in in this Agreement.
17] VIOLATION OF AGREEMENT
- If Guest/s or any member of the Rental Party violates any of the terms of this Agreement, including but not limited to maximum occupancy, visitors and rental rules and restrictions, the Owners may evict the Guest/Rental Party from the Property and the Guest/Rental Party will forfeit all rent.
18] GOVERNING LAW
- This Agreement and all transactions contemplated by this Agreement will be governed by, and constructed and enforced in accordance with the laws of the Republic of Trinidad & Tobago. Any dispute arising from this Agreement shall first be resolved through one on one dialogue or mediation. If the dispute cannot be resolved through either of the above forums, then the dispute will be resolved through the court system.
19] AMENDMENTS
- This Agreement may be amended or modified only by a written agreement signed or acknowledged by both Owners and Guest/s.
20] NO WAIVER
- Neither Owners nor Guest/s shall be deemed to have waived any provision of this Agreement or the exercise of any rights held under this Agreement, unless such waiver is made expressly and in writing and agreed upon by the owners.
21] SEVERABILITY
- If any provision of this Agreement is held to be invalid or unenforceable in whole or in part, the remaining provisions shall not be affected and shall continue to be valid and enforceable as though the invalid or unenforceable parts had not been included in this Agreement.
22] NOTICES
- Any notice or communication under this Agreement must be in writing or oral recording and sent via one of the following medium:

23] SUCCESSORS & ASSIGNEES
- In an event of the untimely death or absence of the Owners, this Agreement will inure to the benefit of and be binding upon Owners, his/her successors and assignees.
24] ENTIRE AGREEMENT
- This Agreement represents the entire understanding and agreement between the Parties with respect to the subject matter of this Agreement and supersedes all other negotiations, understandings and representations (if any) made by and between the Parties.
